Terms of Use

These terms apply to the As-of-Right app and website (“As-of-Right”), published by Chris Karalis. If you use the iPhone app, Apple’s Licensed Application End User License Agreement also applies. If the two conflict, these terms control to the extent the Apple agreement allows.

Preliminary information only

As-of-Right gives a first look at a site. Have everything verified by a licensed architect and/or a zoning attorney before you buy, sign, file or rely on it.

Zoning envelopes, floor area, comparable sales, land values and record summaries are modeled automatically from public City data that can be incomplete, out of date or wrong. The zoning model simplifies the Zoning Resolution. Nothing in As-of-Right is a zoning analysis, survey, title report, appraisal, or legal, financial or professional advice, and using it doesn’t create any professional relationship.

Subscriptions and purchases

• As-of-Right Pro, monthly: renews automatically each month at the price shown in the app until you cancel. New subscribers may get a free trial. When the trial ends, the subscription starts and you’re charged unless you cancel at least 24 hours before the trial ends.
• Payment is charged to your Apple Account. The subscription renews unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
• Manage or cancel in your iPhone’s Settings › your name › Subscriptions. Canceling stops the next renewal; you keep access until the end of the period you paid for.
• Founder lifetime: a one-time purchase, not a subscription. It gives access to As-of-Right Pro for as long as As-of-Right is offered on the App Store, and it never renews.
• Refunds are handled by Apple under its policies: reportaproblem.apple.com.
• Prices and features may change. A price change for an existing subscription follows Apple’s rules, including notice to you.

Acceptable use

Use As-of-Right lawfully. Don’t use it to harass property owners or anyone else, to scrape or resell its output in bulk, or to interfere with the City services it relies on. Owner letters you send are your own communications and your responsibility.

Public data and third-party services

As-of-Right displays information from New York City and other public sources and links to their websites. We don’t control those sources and aren’t responsible for their accuracy, availability or terms. A City service being down can make parts of As-of-Right unavailable.

No warranty

As-of-Right is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose and non-infringement, to the fullest extent the law allows.

Limitation of liability

To the fullest extent the law allows, the publisher of As-of-Right isn’t liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, deposits, financing or opportunities, arising from your use of or reliance on As-of-Right. Total liability for any claim is limited to the amount you paid for As-of-Right in the 12 months before the claim.

Governing law

These terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules. Courts located in New York State have jurisdiction over any dispute.
